Abstract

The case of Edward Snowden and the judgment of the Court of Justice of the European Union in the case Maximilian Schrems v Data Protection Commissioner Data Protection Commissioner and Facebook Ireland Ltd, led to a change in the optics of data transfer, including flight passenger data to third countries, and in particular to the USA. The repeal of the so-called Privacy Shield and introduction in 2021 by the European Commission of new standard contractual clauses justify a review of the existing regulations relating to the transfer of data, including air passenger data.
